DESCRIPTION

The presenters will provide expert knowledge on the topic of performance-based actions with a review of Merit Systems Protection Board (MSPB) case law and an examination of performance-based actions under 5 U.S.C. chapter 43 and chapter 75. This Roundtable will broaden Employee and Labor Relations practitioners’ understanding of the requirements for performance-based actions and the two major processes established by law for dealing with poor performance. The speakers will engage Employee Relations practitioners on many facets of this important topic, to include the following:

  • Presenting a supportable and successful performance-based action at the MSPB
  • Understanding the legal framework of merit-based principles and constitutional law to comport with the right of due process
  • Reviewing the key elements required by Chapter 43 and Chapter 75 and their significance
  • Recognizing the strategic advantages and flexibility available through either Chapter 43 or Chapter 75 to address poor performance
