Course Title: Case Law Update and Practical Discussion on Disability Law and Reasonable Accommodation


Course Description: Mr. Maxin will provide expert knowledge on the topic of disability law and reasonable accommodation, focusing on recent cases before the Merit Systems Protection Board, Equal Employment Opportunity Commission, and the federal courts in this complex area. The presentation will also identify various practical tips and perspectives to ensure reasonable accommodation issues are properly handled. This discussion will include the following:

  • Reviewing relevant disability law terms such as essential functions, qualified individual with a disability, reasonable accommodation, undue hardship and direct threat
  • Handling a performance or conduct problem when the employee has a disability and requests reasonable accommodation
  • Dealing with “Medical Inability to Perform” cases
  • Ensuring reasonable accommodation decisions are based on sound medical judgment, with a focus on when to seek the judgment of a medical professional, how to obtain a medical opinion, and the consequences of an employee’s refusal to obtain a medical opinion
  • Examining recent case law that addresses a wide array of typical reasonable accommodations such as telework, leave, reassignment, job restructuring, and technology
